Abstract

Abstract Due to the worsening of violence, within the Brazilian society, which affects all social strata, from the periphery to the upper class, where the impotence of the bodies and state security bodies is presented clearly. The state of insecurity has widened due to a sensationalist journalism at the moment, spreading terror and inflates the social mood. In this vein, government entities resort to criminal law as miracle cure, which seeks to criminalize more behaviors and the stiffening of penalties. It is this institutional chaos scenario face violence, that in fact there, which clears the draft proposed amendment to the Constitution nº 171 of 1993, which has the aim of reducing the legal age of 18 years to 16 years as one of the fronts expansion of crime fighting. The research in question, making use of a qualitative analysis methodology, using the methods of hypothetical-deductive approach of descriptive and analytical character, is the bottom line analyze the theme of reduction of the penal age and (in) appropriateness to social axiological vectors carved in the Federal Constitution.
