Resumen

BERMUDEZ CASTRO, Juan Christian et al. Artificial intelligence and human rights in the peruvian legal system: a systematic review. Tribunal [online]. 2025, vol.5, n.13, pp.676-695.  Epub 02-Oct-2025. ISSN 2959-6513.  https://doi.org/10.59659/revistatribunal.v5i13.295.

Artificial intelligence transforms social and legal processes, yet it raises ethical and legal risks. Its responsible use requires ensuring transparency, fairness, and the protection of fundamental rights, avoiding algorithmic discrimination and guaranteeing that technology respects human dignity. Accordingly, the objective of this study was to critically analyze academic evidence regarding its impacts and regulatory challenges. This research was characterized as a basic study with a non-experimental, cross-sectional design focused on documentary analysis. A PRISMA systematic review of 30 studies (2018-2025) was conducted. Quantitative results identified the main risks as algorithmic opacity (35.5%), regulatory gaps (32.3%), and threats to privacy (29%). It is concluded that it is imperative to develop a comprehensive regulatory framework based on transparency, independent oversight, and citizen participation to harmonize technological development with the effective protection of fundamental rights.
