Education is a fundamental human right; therefore, it is logical that all people should have access to it under equal conditions and with the same opportunities. The objective of the study was to analyze from a conceptual perspective the problems of basic education in Peru during COVID-19. A literature review was conducted, establishing the inclusion criteria, original or review articles, physical or digital books, Spanish and English language, years 2020-2022 and citable documents; in addition, the search engines Scopus, SciELO, Wos and Google Scholar were approached. It was concluded that basic education in times of pandemic, went from being a fundamental right to a right without equity, justice and inclusion for many students, which requires a change in the Peruvian education system, aimed at reducing or eradicating inequalities and thus provide an inclusive and egalitarian education for all.
