Abstract

The analysis of the social context of Bolivia until the 2013 administration reflected the invisibilization of feminicide compared to other crimes, and with the purpose of complying with international obligations regarding women's human rights, Bolivia classified feminicide as a crime, which when responding to a social context, leaves aside that the use of Criminal Law must be framed in the limiting principles of ius puniendi, avoiding its irrational use that violates basic principles of the Constitutional State of Law, and in no way can it be considered the only mechanism of social control, converting Criminal Law into Criminal Law of the Enemy that dehumanizes and relativizes the rights of those accused of feminicide, and makes the victims invisible.
