Abstract The Constitution of the Bolivian State (CPE) enshrines the material truth as one of its principles, and a civil process of knowledge is designed on the basis thereof, in which the judge is responsible for seeking the truth, granting the legislator in the new Code of Civil Procedure (CPC) evidentiary powers, even producing evidence ex officio. This paper analyzes the debate on the incorporation of evidentiary powers in Bolivian legislation and its application in the civil procedural norm
