Abstract
AGUILAR CAMACHO, Edgar Gustavo. La jerarquización constitucional de los Tratados Internacionales en materia de Derecho Internacional Privado. Análisis de la interacción entre las fuentes nacionales e internacionales a partir de la Constitución y el monismo moderado. Rev. Jur. Der. [online]. 2024, vol.13, n.20, pp.297-314. ISSN 2413-2810.
Abstract In constitutional law, the principle of normative hierarchy is identified, which determines the location and hierarchical rank of norms within a legal system. Therefore, in the present work, the Constitutional Hierarchy of International Treaties in the field of Private International Law is analyzed. The research design is non-experimental in nature, collecting data at a specific moment, in a single time frame, with the purpose of determining the state of the art and analyzing its impact and interrelation at a given moment, supported by legal doctrine, as it is a qualitative research. Finally, it is proposed to reconsider the constitutional hierarchy of international treaties in the field of private international law, adopting the theory of tacitly accepted moderate monism by the Bolivian Constitution
Keywords : Hierarchy of norms; moderate monism; national law; international law; Private International Law.
