Abstract The biotechnological advance opened a debate about the ethical positions that legal systems should take in order to understand and guide the development of human life. Studies on genetic engineering and intervention in offspring's biological allocation - also termed as procreative freedom - have generated a phenomenon in which, on one side, transhumanist's postulates question the limits of what is so far known and named as humanity, and on the other side, a bioethic that pretends to limit scientific development in order to protect fundamental rights.
