Abstract

FRANCO ZAMORA, Paul Enrique. The protection of rights and protection of guarantees, based on digitized constitutional justice. Rev. Jur. Der. [online]. 2022, vol.11, n.16, pp.97-110. ISSN 2413-2810.

Abstract The digitization of constitutional justice is a phenomenon that accompanies the construc- tion of new trends in Constitutional Law and Constitutional Procedure. The implemen- tation of judicial telematics provides, to the constitutional judge, multiple virtual tools in the protection of fundamental rights and protection of jurisdictional guarantees, making it possible for the advancement of technology to become a potential legal ally of the administration of justice. From this scientific article, the legal nature of constitutional justice with digitized components is revealed, the effects it triggers in the procedure, a comparative analysis on its implementation in Courts or Constitutional Tribunals and to establish to what extent injuries are avoided to those who interpose actions or resources

Keywords : Digital constitutional justice; telematic protection of fundamental rights; virtual protection of jurisdictional guarantees; electronic administration of justice; online justice.
