Abstract This article makes synthetic reference to some antecedents that allowed the achievement of legal advances around the recognition of the rights and the character of nature as a subject of law or of its components in the legal systems of some countries. Likewise, as a central part, this biocentric approach is addressed as a new paradigm, legally established in Bolivia, however, under some contradictions and legal gaps that have been identified and briefly analyzed in order to verify if there really is a legal guardianship of Mother Earth, as it is traditionally called in Bolivia and whether or not it is effective, within the framework of current national environmental legislation
