Abstract The philosophical foundations in multiple legal institutes, accompany the dogmatic construction in the administration of justice. A fairly recurrent notion among judges supposes effective judicial protection, however, the new perspective of Constitutional Law, encourages the analysis of a theoretical-doctrinal concept related to effective constitutional protection, whose particular characteristics and its own legal configuration favor the constitutional jurisdiction, to object to understand the meaning of the protection of rights and safeguard of guarantees. This article becomes a scientific contribution regarding the dogmatic scope of effective constitutional protection, as an effective mechanism for those who go to the judicial apparatus and yearn for the fair processing of constitutional actions or resources.
