Abstract

CORDINI, LL.M, Nicolás Santiago. The harmonizaron of criminal law: a process with different actors and at different speeds. Rev. Jur. Der. [online]. 2020, vol.9, n.13, pp.51-70. ISSN 2413-2810.

Abstract The internationalization of Criminal Law is carried out through various mechanisms, including the harmonization. In the present paper, we will focus on analysing the phenomenon of internationalization of Criminal Law from the mechanism known as 'harmonization' through the various agents that set this process in motion, as well as the mechanisms (hard and soft law rules) by means of which the process is carried out. Based on the hypothesis that even in a same área of Criminal Law, the harmonization of Criminal Law has not a uniform character, but it operates in different degrees and speeds from different actors in conflict, we will analyse three cases belonging to the same área of Criminal law, that is, criminal offences associated with organized crime. The selection of cases is: (a) 'criminal association' vs. 'conspiracy'; (b) the trafficking in persons and(c) the money laundering.

Keywords : internationalization; harmonization; Criminal Law.
