Abstract The present article describes the first well-known wave of feminism and the first critical theory stage. Identified their main assumptions, both currents of thought imply an onslaught of the order instituted by promoting a resignificance with the law. On the one hand, the first intellectual feminist promotes the inclusion of the women and the sense of equal rights. At the same time, the critical current questions about the order instituted on the basis of concepts that the law sustains (description). Due to this analysis, it is revealed that both law and feminism feed into each other, while emancipation allows the creation of a right from diminished social spaces, being possible to resist with it.
