Abstract The constitutional normative dimension of criminal law raises the conditions of constitutional legitimacy of criminal normative elaborations to a level of analysis to take into consideration the structures of a reality to be regulated based on the relationship between criminal law and constitutional law, promoting the value importance of the first based on general principles of the second. The relationship between the Constitution and criminal law, merged primarily from the fundamental rights in the construction of criminal legal norms, brings with it the protection of legal property, but at the same time justifies its involvement with the criminal sanction
