Abstract The right to a healthy environment is increasingly complex due to risk and danger situations from climate change as a natural process and human action in the use of natural resources in an abusive way, generating effects that infringe and break environmental law. Therefore, the purpose of this work is to reiterate the importance of the principles of prevention and caution as an incentive in the system of access to justice, not only of particular interest, but also collective for the common good. Relating to these principles, it is highlighted the linkage with the affectation of violated human rights on the basis of the non-guarantee and protection of the right to a healthy environment, as well as the interdependence, indivisibility and progressiveness of human rights
