Abstract

Abstract The problem and the object of the reflection refer to the unfortunate, confusing and misleading use in the ten constitutional provisions where, instead of providing about the general requirements or conditions to access the performance of the "public functions" in coherence with the fundamental rights of citizenship, the term "public service" and the concept "public servant" have been used. They are three different conceptual categories that in legal practice are intended to be understood as synonyms, which becomes a legal barbarism since it realizes that this Constitution is not made for the Bolivian people, but for experts.
