Abstract The present paper analyzes the evidentiary issues regarding with the European process governed by Regulation (EC) N. - 861/2007 of the European Parliament and of the Council of July 11th, 2007, establishing a European small claims procedure, later refurbished in 2015. It applies to the civil and commercial cross-borderdemands, whetherthey are subjectto reply or not, of an amount not exceeding €5,000, and also ensures that the sentences dictated in this process are executable without any intermediate process, in particular, without the need for a declaration of Executive Force in the executing Member State, since the exequatur is deleted.
