Abstract The present work intends to provide a theoretical analysis of the crimes of genocide, crimes against humanity and war, defined by the Statute of the International Criminal Court or Rome Statute and proposes the adaptation of domestic criminal norms to the parameters of the aforementioned supra national norm, due to the intense involvement of human rights that would mean the commission of the aforementioned crimes and the need for their prosecution, as well as the importance assigned to them by the Political Constitution of the State when it establishes the nature of its imprescriptibility, the fact that Human rights treaties in Bolivia integrate the so-called constitutional block and the principles of pacta sunt servanda and bonna fide that govern international law.
