Abstract In this article, the scope of applicability of the competence prohibition on the passive subject is studied, considering that this is the main actor on which all possible activities will devolve -whether current or potential-. The constant changes in regulations and the positive evolution of corporate management, have developed greater control of analysis and study on participation, enrollment, administration and passive subject correspondence in the Company.
