Summary The analysis about the social problems, must necessarily be linked to the study of the family law, understanding families as the social core in which the first human relations are settled and that directly influence the integral development of the individual and which later become the origin or cause of certain behaviors that finally converge in social phenomena that cause repercussions in the order and the harmonious coexistence of society. In this sense, this purpose of this paper is to propose as a guaranty and protection of the families' rights, constitutionalized as fundamental rights in Bolivia since the promulgations of the 2009 Constitution, the application of the Right to Damages in cases in which parents incur in parental alienation against children, due to family conflicts in divorce processes or separation of the parents.
