From the social point of view, identity of the people with different abilities (pwd; hereafter) is a social construction, which permits to interpret the facts related to this community in terms of the defense of human rights. In the context of the Rule of Law, it isassumedthatthe State mustensure social welfare and fulfill the needs of people with equity. However, what happens when the State, is the one who violates the principles and laws that protect their rights and discriminate them? To what extent the Bolivian State has made progress in the approach, concepts, classifications and actions on disability? The hypothesis is a defence and protection of pwd's rights, which has been translated into laws and governmental speeches, but has not been transited into State's practices through public policies. The research is based on the process and results of the pdw's protest which took place in La Paz, Bolivia (between March and July 2016) caused by a demand of a monthly social bonus of Bs. 500; referring to a socio-economic demands and the need to be recognized as part of the State, moreover to the possibility to access control of the resources (materials and symbolic), additionally strengthen their capacities and leadership in individual and collective level. From this perspective it is imperativeto repairthe damage doneto pwd and restore their rights. This should be done by the State.
