Abstract

The Rights of Indigenous Peoples in the current Constitution of the State are one of the central themes of analysis, because the Bolivian government has recognized several international treaties and conventions that deal with the protection of the rights of indigenous peoples, fundamentally right of self-determination of people, which is integrally related to the right to prior consultation. The fundamental right of indigenous people is to decide on judicial and administrative matter, when it comes to execution of projects, constructions or activities within their lands, seeking in this way to protect its cultural, social and economic integrity and ensure the right to participation and self-determination. The basis of the consultation is the right to decide on the priorities that emerge from the process of development in the formulation, implementation and evaluation of plans and programs for national and regional development, which are capable of involvement.
