Abstract

In the document approach the question of divorce on the horizon of the Code of the Families and Family Process, in which it is conceived a new form of reparation conjugal. Divorce is no longer the controversial issue of yesteryear. Ways and means today discusses how you can contribute to family stability. The problem is not divorce but the crisis in the family and social goals. The frustration of the marriage project originated dueto psychological conflictsordifficulties in communication and living conditions circumstances. It argues that the family is losing control over its core functions: biological and social reproduction, parenting, sharing their intellectual and moral training, communication among its members. As the family is no longer the field of realization of a life project the core tends to disintegration, atomization. So the concept for understanding the divorce is "breaking the project of living together". This approach overcomes the need to make judgments about reconciliation or continuation of the process. And there is nothing to prove. This assumption leads to the conclusion that spouses do not need to express what is the reason for the separation, being reserved for them the real reasons to dissolve their marriage. In the article the features of notarial divorce, the proceedings of the judicial divorce, legal social an economic effects of divorce also.
