Abstract

BORELLI GELDREZ, Diana. Las bofetadas al Derecho de Asilo Diplomático. Rev. Jur. Der. [online]. 2015, vol.1, n.2, pp.25-31. ISSN 2413-2810.

The right of diplomatic asylum, as is currently understand and practice is more a state law thatthe right of a person. I considerthatthe right of diplomatic asylum, as well as territorial isan integral and indispensable partof international and human rights law, precisely because of its scope of humanitarian respectable depth. Be that as it may, the right of diplomatic asylum is to just protect the first human right that exist and that is to life. In the current international law, the state has not obligation to grant diplomatic asylum. As determined forexample the 1954 Caracas Convention on Diplomatic Asylum and theSCELLE doctrine assert that the state is obliged to grant asylum. Diplomatic asylum is granted to political persecution, including those who fight against colonialism in any color. But it can not an should not give the terrorists, war criminals or those who committed crimes against peace, crimes against humanity and those who have committed or ordered the crime of aggression

Keywords : diplomatic asylum; human rights; rule; right international; pass; urgent; political offense; criminal offense.
