From the 90's in South America have been experiencedchanges in constitutional scriptures, this process has come to be calleda new Latin American constitutionalism. The category in which the catalog of rights extendsto the Political Constitution of the State of Bolivia among others, which reaches benefits from the guarantees and actions of the fundamental rights, and all rights established in the Constitution and international treaties. Inthis regard, it ¡s questionable whetherfrom the validity of this fundamental normative text, the practical context has been achieved and implement as designed by the Constituent Assembly,and what are the levels of effective protection of human rights. For this purpose, the analysis has been identified particularly to the territory of the Plurinational State of Bolivia.
