Abstract This research develops an approach to the process of construction of the legal framework, its representation of reality and its coherence with the latter in Bolivia. It evidences the coherence of the construction of a legal framework that promotes racism in ignorance of the diverse Bolivian reality. It talks about the process that takes place from the beginning of the human presence in Bolivia, its complexity from its materiality in the day to day and its social and political organi-zation, which also translates into penalties, caste privileges and discriminations, which take a particular course from the presence of African slaves, and that, in the republican era in Bolivia, is delayed in its abolition by that duality between reality and legality.
