Abstract The problem of crime is an issue that plagues all societies today and if it is of a sexual nature, affects even more. Sex offenders have complex and dangerous personalities, but not all are equal and leave with the same motivations or pathologies. It depends on factors such as age, socialization, environment, channeling forms of pathology, etc. Justice when found guilty of throwing into the various prisons, but not classified by their differences, does not offer them adequate and differential treatment from psychology, which would be responsible forfinding the positive behavior change. To this sui generis prison culture of our prisons and the effects of prisionalización that arise during the closure adds. The combined analysis of these factors is discussed in this article with a solely theoretical methodology, concluding that this phenomenon should be studied more scientific and systematic detail, since the time of sentencing and tougher penalties are not the solution for crime and less of a sexual nature, generating a high level of recidivism, so to look for other processes within the laws or modification of any of these.
