Abstract

According to the interpretive paradigm, through the exegetical and systematic methods, through documentary study and within the framework of the theories of positive Law of Hans Kelsen and Riccardo Guastini, as well as the Bolivian history of the 19th century, the present investigation determined the relationship between International Law with the Bolivian Law of 1826. Their results indicate that the original Bolivian Law made partial reference to International Law, having been qualified, in general, as expressly monistic. Specifically, it was monistic regarding the treaty-making statute of customary international law, and tacitly dualistic about all other matters regulated by it. He was also a monist in terms of conventional international law.
