Abstract

The recognition of rights and freedoms is one of the main characteristics of the functionality of a Constitution; in that sense, the constitutionalism throughout its history has been designing and providing new ways to make people fully exercise their fundamental rights. So, this article will explain how the new Latin American constitutionalism proposes a new classification of fundamental rights, overcoming generational classification of them, aiming to create a greater and better recognition and exercise of the fundamental rights by citizens extending the concept of human dignity.
