Abstract

CRUZ, Madeleine. AN APPROACH OF THE FEMINICITY NOTION FROM A PSYCHOANALYTICAL PERSPECTIVE AS A RESOURCE TO IMPROVE THE APPLICATION OF LEGAL REGULATIONS. Ajayu [online]. 2017, vol.15, n.2, pp.214-251. ISSN 2077-2161.

The purpose of this research is to explore the concepts of gender, gender violence, and feminism from both the legal and psychoanalytic perspective while taking into consideration concepts such as subjective constitution, mirror stage, Oedipus and enjoyment. In using these theories, it will be possible to show that the differences between the feminine and masculine genders are given in the subjective constitution of the subject, producing certain psychic consequences that give rise to the subjective position with which the subjects are represented throughout their life. From the analysis it was possible to concluded that there are many gaps and inconsistencies in the conception and classification for the criminal act of femicide, where the legal position and the feminist discourse have proved insufficient in explaining and solving the femicide problem. Gender violence goes beyond the hatred of one sex towards another; aggressiveness is not a gender issue but a constituent part of the subject. With gender violence we must resort to other theories and tools, such as psychoanalytic theory, in order to explain and understand femicide.

Keywords : Femicide; violence; gender; subjective constitution; enjoyment; aggressiveness.
