LAISE, Luciano D.. The Functions of The Concept of 'Dignity' in Legal Interpretation. Fides Et Ratio [online]. 2017, vol.14, n.14, pp.115-126. ISSN 2071-081X.
Abstract Human dignity usually performs two functions in the legal discourse. (ii) Dignity is used as a directly operative fundamental right. Second, some authors hold that human dignity refers to the justification of human rights. Nevertheless, if the concept of human dignity is interpreted in a context of moral andpolitical fragmentation, this will result in contradictory interpretations. Thus, this article will hold that dignity may guide the interpretation of those rights, if the concept necessarily refers to the instantiation of basic human goods; that is, if the meaning of dignity is linked to the flourishing of human person.
Palabras clave : Basic human goods; dignity; legal discourse; legal interpretation.
