Resumen

FERNANDEZ FAGALDE, Luis. CONSTITUTIONALISING COLLECTIVE NEGOTIATION. Fides Et Ratio [online]. 2014, vol.8, n.8, pp.59-65. ISSN 2071-081X.

Absctract The State Constitution, promulgated on February 7, 2009, in his third section, entitled Labour and Employment, Article 49 recognizes collective bargaining as part of labor rights. The incorporation of this legal concept, constitutive of Collective Labour Law, contributes to the design of a new legal scenario that should enable the solution of permanent labor disputes through dialogue and consultation. In this context, collective bargaining and social dialogue must be assumed as preventive means permanent within labor relations, enabling their practical and effective eradication of conflict in the relationship between workers and employers.

Palabras clave : Collective negotiation; social dialogue; Right to Work and Employment; General Labor Law.
