Abstract

The protection of the person through the different subjects that integrate ¡t into the family, acquires different connotations according to the socio-political and economic characteristics of the country. This allows us to present a reality about Family Law that is removed from Roman law in some fundamental institutions and with the perspective of the protection of human rights and its constitutionalisation in the Mexican legal system. This work has been carried out to highlight the paradigmatic change of certain family institutions, some of which have changed in the context of prívate international law, others that are characteristic of Mexican historical and cultural characteristics and the development of family law as an autonomous discipline of Civil Law by the presence of public order in the development of the family, where the best interests of the child and the protection of the weakest subject matter, this article highlights several figures who have played a fundamental role in the new conception of the right of family as the concubinage and the family patrimony.
