Abstract: The conceptof family, based solely on a lawful union between man and woman, has gradually evolved and has been joined by new types of unions heterosexual and homosexual.The process of accreditation of new families has been slow and difficult, but it is a phenomenon that can no longer be omitted from national legislators who, in the wake of the law in action, have gradually begun the process of legislative protection in the field of successions, also through new contracts based on the German experience.This evolution law becomes, however, more tortuous and difficult in the Italian system, conditioned by the presence of Catholic values and a peculiar meaning of "public order".The evolution of the phenomenon of the new families and the urgent needs of the partners require, however, to revise the ancient dogmas and the traditional principles.
