Abstract

CLIMENT GALLART, Jorge Antonio. Analysis of the origins of freedom of expression as an explanation of its current configuration as an institutional guarantee. Rev. Bol. Der. [online]. 2016, n.22, pp.236-253. ISSN 2070-8157.

Abstract: The current configuration of freedom of expression as an institutional guarantee of the democracy has its doctrinal origin in the seventeenth-century England, even though its consolidation was in the US First Amendment. Precisely the theses about freedom of expression in general and on freedom of the press in particular kept by the Founding Fathers of the United States, will then be fully embraced by the US Supreme Court. The ECHR has ended applying the thesis of this American Court to resol ve those conflicts in which that freedom is at stake.

Keywords : Freedom of expression; freedom of the press; democracy; truth.
