Law of 31 March 2010 ("Ley de Lucha contra la corrupción, enriquecimiento ilícito e investigación de fortunas 'Marcelo Quiroga Santa Cruz'") introduced stronger penalties for certain offences involving public corruption, affecting among others the figure described in art. 147 of the Bolivian Penal Law (acceptance of benefits). This paper tries to make an attempt to examine the linkage between gift giving and corruption, containing ideas regarding the role of the prohibition to accept gratuities in order to guarantee all citizens equal access to public services.
