Abstract

TALAVERA FERNANDEZ, Pedro. Difficulties of current subjectivist paradigm of health for its configuration as a universal human right. Rev. Bol. Der. [online]. 2016, n.21, pp.16-47. ISSN 2070-8157.

The paper analyses, firstly, the requirements and implications derived from the acknowledgment of health as a human right, its foundation and justification and the means to legally guarantee it as an essential social right. Secondly, it is considered the subjective concept of health from the definition adopted by the WHO and the problems thatthis definition raises in order to identify the essential contents of the right to health and the reality of the sanitary attention in the first and the third world.
