ABSTRACT:This case-law comment analyzes several judgments of the Court of Justice of the European Union in order to assess whether the forum delicti commissi rule contained in art. 5(3) of the Brussels I Regulation -art. 7(2) of the Brussels I Recast- covers actions for a negative declaration when, in the framework of a process of non-infringement of a patent right, the question of invalidity of the patent at stake is risen.
