One of the legal instruments traditionally used by European States, including Spain, in its housing policy to facilitate the access of the citizens, is the regulation that, in generic mode, can be described as social or protected housing. This analysis focuses on an aspect which, as practice shows, is field paid for fraud when there is a proper work of inspection by public administrations: limitations to the faculty of enjoyment that affect the owner (and also the tenant or owner of such powers under other law, such as that of surface) of housing.
