In Spanish law there is a diversity of legal treatment of the right of use of the family home in cases of nullity of marriage, separation or divorce, which affects its legal regime. In particular, concerning to the possibility of agreeing a temporary limit in practice, with children in potestate, or being suitable with an economic compensation, issues that confront the rules of common law and the doctrine of the Tribunal Supremo with the rules of some Comunidades Autónomas that have legislated aboutthis subject.
