ABSTRACT: The "actual knowledge" exists according to the following two reasons. First, although a priori the Administrator could not filter the posts, the website had a tool to detect and moderate the content of posts. Second, the comment was so deeply defamatory that the plaintiff honor was clearly injured. Moreover, the Administrators were not diligent in the data deleting or blocking the access to them.
