Abstract

JIMENEZ MUNOZ, Francisco Javier. REFUSAL OF REGISTRATIONOF PARENTAGE DETERMINED BYTHE CONCLUSION OF A SURROGATE MOTHERHOOD CONTRACT. COMMENT ON STS NO. 835/2013, OF 6 FEBRUARY 2014 (RJ 2014,736). Rev. Bol. Der. [online]. 2014, n.18, pp.400-418. ISSN 2070-8157.

ABSTRACT: It is not acceptable the recognition of foreign decisions on parentage for intentional parents, derived from a surrogacy contract, as it is against the Spanish international public order. The primary consideration of the child's higher interests must be assessed weighting with the other legal interests.

Keywords : Surrogate motherhood,; registration of filiation; recognition of foreign judgments.
