ABSTRACT: Incapacitaron involves deprivation of the legal capacity of a person by causes indicated ¡n the law, which can only be declared by judicial decisión. Causes of incapacitaron are illness or persistent physical or psychic deficiencies, preventing the person to govern itself. In its judgment the scope of incapacitaron (total or partial), will be established being reviewable, since ¡t has no efficacy of res judicata, since conditions physical or psychic of the incapable may vary.
