Abstract

The use of hidden camera in the investigative journalism is very common nowadays. The Supreme Court has considered the method as legitimate,although it has sometimes declared the hidden camera as invasive, because it violates the rights to privacy and to own image.The Constitutional Court, however, has deemed it as unconstitutional. It is unclear, however, if it is prohibited in any case, or it could be valid when the image and the sound of the person captured are distorted so far as to not recognize the person.Thus, in my opinion, would be saved their rights to privacy and to own image.
