ABSTRACT: This document sets some legal criteria helpful to differentiate an employment relationship of a relationship civil or commercial and delivers practical recommendations for companies that want outsource or outsourcing activities of his organization, through civil or commercial contracts to provide services. These recommendations intended to prevent that contracts for services used are qualified subsequently as fraud to the labor legislation and, with this, avoid exposure to future labor demands or administrative penalties for breaches of social laws
