Abstract

MASSO GARROTE, Marcos F. FOREIGNER’S CONSTITUTIONAL RIGHTS IN THE NEW LEGAL AND INTERPRETATIVE FRAME OF THE SPANISH CONSTITUTION. Rev. Bol. Der. [online]. 2011, n.11, pp.54-85. ISSN 2070-8157.

The Constitutional Court doctrine set up that although Constitutions are made by national communities, their norms are not only applicable to them, but also to all the people, national or not, who is in the community’s territory. This fact is applicable to the constitutional rights, which belong to the foreigners in the same way that belong to nationals, binding the legislator with the prohibition of enacting regulation that makes it exercise impossible. To sum up, the article is an exercise about the rights’ subjective dimension in the Spanish Constitution

Keywords : Immigration; alien’s laws; nationality; citizenship; constitutional rights; political rights; discrimination; essential content; Constitution.
