Abstract

ROJAS TUDELA, Farit L.. Curriculum oculto en la educación en Derecho. Rev. de Inv. Educ. [online]. 2010, vol.3, n.3, pp.87-95. ISSN 1997-4043.

ABSTRACT the creations of a particular habitus in the teaching of law, not only as a form of symbolic violence, but as the implementation of forms of discrimination and the acceptance of irrational subordination. In this orientation it develops a score of what modernity means and also the assumptions taken for the teaching of human rights in the legal field. The author argues that there is no problematization of what is to be considered "human" in the thought of modern age; this absence has led to a blind treatment of difference of the cognitive conditions of each culture and allowed the development of a vision of the sense of being human in a Eurocentric perspective. Making an issue of the hidden curriculum in law studies would also call the attention on the role of lawyers in societies with colonial remnants, and thus point to the question of the relation between knowledge and power, and the related social hierarchy.

Keywords : hidden curriculum; habitus; law; modern thought; human rights.
