Abstract

En 2009, during an indigenous meeting in the Bolivian Amazon, the former Trinitarian leader Marcial Fabricano was punished with more than 50 lashes, according to his executioners for having promoted the territorial division and the illegal sale of wood. Fabricano alluded to political persecution, denied the accusations and began a legal process against the lashers via state courts. The article analyzes, from legal anthropology, the causes and elements that characterized this indigenous justice process; in addition, the socio-political dynamics between the clans that vie for power in the indigenous territory are examined in order to fully understand the antecedents of the case.
