Summary I believe that Criminal Law represents an area of scientific and human passion that can allow us to build a human coexistence without Criminal Law, but I also believe that it becomes a chimerical expedition when, absorbing one intelligence from another, it is barely achieved an minimum comprehension of that human aspiration. For this reason, the present paper approaches, although without depth, a contradiction between the pretension of achieving a harmonious and peaceful coexistence and the emergence of criminal laws that challenge the rationality and ethical criteria of power, when criminal norms are constructed without considering the basis of a material Constitution, or the formulation of re-socializing criminal policies in order to reflect on the ideological and political incongruities of criminal populism.
