Abstract

ENRIQUEZ SORDO, Jorge. Does the cuban legal system have sufficient tools to protect the right of disposal of the corpse?.. Rev. Bol. Der. [online]. 2018, n.25, pp.62-109. ISSN 2070-8157.

With these lines we seek to reflect about the poor protection of the right to dispose of the corpse in the substantive and procedural civil law in Cuba. It starts analyzing the successes and failures of regulation of this right in the mentioned areas, and the need of our law to understand it essence, in order to avoid future litigation and that the right under study can be performed in a more fully way, as long as the legislation is modified. In addition, the last sentence issued by the Supreme Court of Cuba on the subject is critically analyzed, and it is a question of illustrating how this insufficient protection is manifested before a specific facet of this right.
