Abstract

MERCHEL, Dominika. Evidence proceedings in a polish criminal trial. Rev. Jur. Der. [online]. 2016, vol.3, n.4, pp.83-92. ISSN 2413-2810.

Summary The text contains elementary information about grounds of polish criminal trial procedure with reference to other modern European trials. It refers to dominant principles about gathering and examination of evidence such as principle of material truth, principle of direct examination and principle of free assessment of evidence. Moreover, it includes detailed regulations of the code of criminal procedure. Further, it points out number of difficulties related to the big amendment of criminal trial adopted in 2015 especially associated with implementation and using of so-called private evidence. The article also discusses various evidences such as testimony of a witness, expert or party and clarify many kinds of witnesses existing in polish law. It also report constructions of the inadmissibility in evidence such as fruits of the poisoned tree.
